Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes what you may and may not do when

It forms part of, and should be read together with, our Terms of Service. By

1. Prohibited content and conduct

You must not use the Service to create, upload, store, generate, or distribute

content, or to engage in conduct, that:

is illegal or facilitates illegal activity under any applicable law;

consists of weapons designs intended to cause harm, or designs intended to

facilitate violence, injury, or other serious physical harm to people;

infringes the intellectual-property, privacy, publicity, or other rights of

any person, or misappropriates trade secrets or confidential information;

is malicious — including malware, or designs or instructions intended to

damage property, defeat safety mechanisms, or cause harm;

attempts to reverse-engineer, decompile, or extract the underlying models,

systems, or source of the Service, except to the extent such restriction is

prohibited by law;

attempts to disrupt, overload, or compromise the Service, its

infrastructure, or its security, including denial-of-service activity,

unauthorized access, or probing for vulnerabilities outside an authorized

program;

involves scraping, harvesting, or automated bulk extraction of the Service

or its content except as expressly permitted;

abuses, harasses, threatens, or defames others, or generates content that

exploits or endangers minors;

attempts to circumvent usage limits, quotas, access controls, or billing,

including sharing or reselling access in violation of your plan; or

provides false information, impersonates others, or misuses another user's

account.

2. Your responsibility for review

The Service generates designs using AI, and generated outputs may contain errors

or be incomplete. You remain responsible for independently reviewing,

validating, and testing any output before manufacturing, fabrication, or any

real-world or safety-critical use. Using the Service does not relieve you of your

own legal and safety obligations.

3. Consequences of violations

If you violate this AUP, we may take action proportionate to the violation,

including issuing a warning, removing or disabling content, limiting features,

suspending or terminating your account, and reporting unlawful activity to the

appropriate authorities. We may act immediately where we believe there is a risk

of harm, legal exposure, or disruption to the Service or other users.

4. Reporting abuse

If you become aware of content or activity that violates this AUP, please report

it to us at [SUPPORT_EMAIL] with enough detail for us to investigate. We

appreciate good-faith reports and will review them promptly.

5. Changes to this policy

We may update this AUP from time to time. When we make material changes, we will

Billing, Usage & Subscriptions

This document explains how billing, usage, and subscriptions work for

[TRADING_NAME], operated by [COMPANY_LEGAL_NAME] ("we", "us", or "our"). It forms

part of, and should be read together with, our Terms of Service. If anything here

1. Usage-based pricing

The Service uses **usage-based pricing that scales with the computational

complexity of each request**. Simpler requests consume fewer usage units; larger

or more complex requests consume more. Usage is measured in **usage units (or

credits)** that are debited from your account as you use the Service. Your

account dashboard shows your current usage so you can track consumption.

2. Subscription plans and included usage

We offer subscription plans, each of which includes an allowance of usage and a

set of features. Plan details — including the included usage allowance, features,

and price — are shown at the point of purchase and in your account. You may also

be offered a free tier with a limited allowance. When your included allowance is

reached, additional usage (where available) may accrue according to your plan, or

the relevant features may be paused until your allowance renews or you upgrade.

3. How charges accrue

Charges accrue as you use the Service. Subscription fees are billed on a

recurring basis (for example, monthly or annually) for the plan you select.

Usage is metered against your plan's allowance, and any applicable usage-based

charges accrue based on the complexity of the requests you make. Your invoices

and usage history are available in your account.

4. Complexity and time expectations

5. Refunds and consumed usage

> Consumed usage is generally non-refundable. Because the Service incurs

6. Payment processing

Payments are handled by a third-party payment processor. By providing payment

details, you authorize us and our payment processor to charge your selected

payment method for the fees and usage you incur. Your payment information is

collected and processed directly by the payment processor under its own terms;

we do not store full payment card details.

7. Taxes

Prices are exclusive of taxes unless stated otherwise. You are responsible for

any applicable taxes, duties, or similar government charges associated with your

purchases, except for taxes based on our net income. Where required, we will

collect and remit applicable taxes.

8. Plan changes and cancellation

You may upgrade, downgrade, or cancel your subscription from your account.

Upgrades may take effect immediately, and downgrades or cancellations generally

take effect at the end of your current billing period unless stated otherwise.

After cancellation, you retain access to paid features until the end of the

period you have already paid for. Changes to allowances or pricing apply going

forward from the effective date of the change.

9. Failed payments

If a payment fails, we may retry the charge and may suspend or limit access to

paid features until the outstanding amount is paid. We will make reasonable

efforts to notify you of failed payments so you can update your payment method.

10. Changes to pricing and this document

We may change our pricing, plans, or these billing terms from time to time. When

we make material changes, we will update the effective date above and, where

appropriate, provide advance notice. Changes do not apply retroactively to usage

already incurred.

Privacy Policy

This Privacy Policy explains how Oobie ("Oobie," "we," "us," or "our")

collects, uses, discloses, and protects personal data when you use

[oobie.ai](https://oobie.ai), Oobie applications, Oobie APIs, and related

services (collectively, the "Service").

This policy applies to information Oobie handles as the operator of the

Service. It does not apply to a third-party website, model provider, connected

service, or integration that handles information under its own privacy policy.

1. Information we collect

We collect information in the following categories. The examples describe the

Service as it exists on the effective date and are not intended to expand what

we collect.

Account and profile information

We collect your email address, password in protected form, verification status,

display name, full name, optional birthday, and account status. We also store

preferences you choose, such as units, theme, language, general location,

time zone, accessibility settings, notification choices, telemetry choice, and

product-email choice.

User Content and project information

We process the prompts, chat messages, specifications, referenced parts, files,

CAD models, drawings, scripts, previews, revisions, project names and

descriptions, wiki pages, comments, issues, pull requests, release information,

and other material you submit or generate through the Service ("User Content").

Project records may include file paths, formats, sizes, content hashes, change

summaries, storage manifests, and revision history.

Collaboration and public activity

We collect information about project ownership, collaborators, roles,

invitations, sharing, public or private visibility, forks, stars, notifications,

activity, and other actions you take in collaborative features. Your name,

profile information, and activity may be visible to collaborators or the public

when you choose a public feature.

Connected services

If you connect an external tool or Model Context Protocol service, we process

the service name, URL, configuration, tool descriptions, connection status, and

authentication information needed to operate the connection. Oobie encrypts

stored connection secrets and OAuth credentials, but the connected service

receives information you direct Oobie to send to it.

Subscription, transaction, and usage information

We collect your plan, subscription status, renewal period, allowances, storage

use, model and feature usage, token counts, request costs, invoices, transaction

status, and payment-provider identifiers. Stripe processes full payment-card

details. Oobie does not store full payment-card numbers.

Communications, feedback, and diagnostics

We collect messages you send to support, feedback and bug reports, crash

reports, diagnostic information, and product telemetry. These records may

include contact details, app version, platform, device details, user agent,

request identifiers, error information, stack traces, and the content you

choose to include.

Technical, network, and security information

When you use the Service, we process IP address, user agent, browser or app

type, operating system, timestamps, request identifiers, authentication and

session records, rate-limit identifiers, security events, and audit logs. When

you accept a version of Oobie's Privacy Policy or Terms of Service, we record

the version, time, IP address, and user agent as evidence of acceptance.

Derived information

We derive information needed to operate the Service, such as usage summaries,

request complexity, model-routing results, storage totals, security

fingerprints, and likely error groupings. Oobie does not use these operational

inferences to make decisions that produce legal or similarly significant

effects about you.

2. Sources of information

We receive information:

directly from you when you register, configure the Service, submit User

Content, communicate with us, or make a project public;

automatically from your device, app, and use of the Service;

from collaborators and other users who invite you, mention you, or interact

with shared projects;

from Stripe and other vendors that support payments, security, hosting,

email, and service delivery; and

from services you connect or direct Oobie to use.

3. How we use information

We use personal data to:

create and secure accounts, verify email addresses, and manage sessions;

provide AI-assisted chat, CAD generation, project storage, collaboration,

connected tools, backups, and other requested features;

route requests to model providers and return their results;

meter usage, administer subscriptions, process payments, and enforce limits;

provide support, respond to feedback, and send service or security notices;

send product communications when you have chosen to receive them;

diagnose errors, maintain reliability, understand feature use, and improve

the Service, subject to the controls described below;

prevent fraud, abuse, security incidents, and violations of our terms;

establish, exercise, or defend legal claims and comply with law; and

create aggregated or de-identified information that is not reasonably capable

of identifying you.

Oobie does not use User Content to train a general-purpose AI model unless you

separately and affirmatively agree to that use.

4. AI processing

Oobie sends the portions of your request needed to fulfill it to one or more

third-party AI model or model-routing providers. Depending on routing and

availability, this may include the prompt, relevant chat context, tool

descriptions and results, referenced-part details, and generated output. The

provider and routed model may be shown in the Service response.

Model providers may process or temporarily retain this information under their

terms and Oobie's commercial arrangements. Do not submit personal data,

confidential information, export-controlled information, or third-party

material unless you are authorized to do so and its use with an external model

provider is appropriate.

5. Legal bases for processing

Where the GDPR, UK GDPR, or a similar law applies, Oobie relies on:

Contract: to create your account, provide requested features, route model

calls, store projects, support collaboration, and administer your plan.

Legitimate interests: to secure, maintain, troubleshoot, and improve the

Service; prevent fraud and abuse; protect users; and establish legal claims.

We consider the nature of the data, the expected use, and your rights before

relying on this basis.

Consent: for optional product emails, optional analytics, or another use

for which we specifically ask permission. You may withdraw consent at any

time for future processing.

Legal obligation: to meet applicable tax, accounting, sanctions,

regulatory, and lawful-request obligations.

Where information is needed to enter into or perform a contract, failing to

provide it may prevent Oobie from creating an account or delivering the

requested feature.

6. When we disclose information

Oobie may disclose personal data to:

Cloud and operations vendors that provide hosting, storage, databases,

caching, email, diagnostics, security, support, and related infrastructure.

AI and model-routing providers as described in Section 4.

Stripe and billing vendors to create checkout sessions, administer

subscriptions, report usage, process payments, and address payment fraud.

Connected services when you add an integration or direct the Service to

call an external tool.

Collaborators and the public according to project roles, sharing actions,

public visibility, forks, stars, releases, and other settings you choose.

Professional advisers and authorities when reasonably necessary for

accounting, audit, insurance, legal advice, legal process, or the protection

of rights, safety, and security.

Transaction participants in a financing, merger, acquisition,

reorganization, bankruptcy, or sale of assets, subject to appropriate

confidentiality protections.

Oobie does not sell personal data. Oobie does not share personal data for

cross-context behavioral advertising and did not do so during the preceding

12 months. Oobie does not use personal data to offer a financial incentive in

exchange for its collection, sale, or sharing.

7. Retention

We keep personal data only for as long as reasonably necessary for the purpose

described in this policy, including the following criteria:

Account, profile, subscription, and project records are generally kept while

your account or project is active and for a reasonable period afterward to

complete deletion, provide support, resolve disputes, and meet legal duties.

User Content is kept until you delete it, clear the relevant history, close

the account, or Oobie no longer needs it to provide the feature. Deleting a

project removes its files, revisions, and collaborators from active project

storage. Copies made by collaborators or through public forks are controlled

by the holders of those copies.

Oobie writes a chat transcript to its server-side history store only when

chat persistence is enabled for that request. Stored history is bounded and

can be cleared with available controls.

Billing, tax, legal-acceptance, audit, security, and fraud-prevention records

may be kept longer when needed for compliance, accounting, dispute

resolution, or protection of the Service.

Feedback, crash reports, diagnostics, and telemetry are kept for the time

reasonably needed to investigate, aggregate, or improve the Service.

Deletion from active systems may take time to propagate to encrypted backups

or archives. Oobie may retain information subject to a legal hold or another

valid exception. When possible, we delete or de-identify information that is no

longer needed.

8. Security

Oobie uses technical and organizational safeguards designed for the nature of

the information we handle. Measures include encrypted network connections,

server-side encryption for stored artifacts, hashing or encryption of

credentials, access controls, rate limits, audit records, and log redaction.

No system is completely secure. You are responsible for using a strong, unique

password, protecting access tokens, and promptly reporting suspected account

compromise to [[email protected]](mailto:[email protected]).

9. International data transfers

Oobie and its vendors may process information in the United States and other

countries whose laws may differ from those where you live. When applicable law

requires a transfer mechanism, Oobie uses an approved mechanism such as

Standard Contractual Clauses, an adequacy decision, or another lawful

safeguard. You may contact us for information about an applicable safeguard.

10. Your controls

Profile and preferences: You can review and change available profile,

notification, language, location, time-zone, and product settings.

Chat history: Server-side chat persistence is off by default at the API

level. When enabled by your client settings, you can clear stored

conversations using available history controls.

Telemetry and analytics: You can turn telemetry off in settings.

Optional usage analytics are processed only when that setting is enabled.

Service-required metering, security, and audit processing continue.

Email: You can opt out of product emails through settings or an

unsubscribe mechanism. Oobie may still send account, billing, security, and

other non-promotional messages.

Projects and integrations: Projects are private by default. Review

visibility, collaborator, webhook, and connected-service settings before

sharing information.

Oobie may use essential cookies, app storage, or similar technologies to

authenticate users, preserve preferences, protect the Service, and complete

payments. Oobie does not use advertising cookies. If optional browser analytics

are introduced, Oobie will provide controls where required.

Because Oobie does not sell personal data or use it for cross-context

behavioral advertising, browser Do Not Track signals do not change those

practices. Where applicable law requires us to recognize a Global Privacy

Control or similar signal, we will treat it as the legally required opt-out.

11. Your privacy rights

Depending on where you live, you may have the right to:

know whether and how Oobie processes your personal data;

access or obtain a portable copy of personal data;

correct inaccurate personal data;

delete personal data, subject to lawful exceptions;

restrict or object to certain processing;

withdraw consent for future processing;

opt out of a sale, sharing for targeted advertising, or certain profiling;

limit certain uses of sensitive personal data;

appeal a denied request; and

receive equal service and pricing without unlawful discrimination for

exercising a privacy right.

Use available account controls or email

the right you wish to exercise and the account involved. We may verify your

identity and authority before acting. An authorized agent may submit a request

where permitted by law, but we may require proof of authorization or direct

verification with you.

If we deny a request, you may appeal by replying to our decision with the

subject "Privacy Appeal." You may also complain to your local data-protection

or privacy regulator.

12. Additional California disclosures

If the California Consumer Privacy Act applies, the categories Oobie collected

during the preceding 12 months include identifiers; customer-record

information; commercial information; internet or other electronic-network

activity; general geolocation or location preferences; User Content and other

electronic information; and inferences described in Section 1. The sources,

business purposes, and categories of recipients are described in Sections 2,

3, and 6.

Account log-in credentials and connected-service credentials may qualify as

sensitive personal information. Oobie uses them only to authenticate, secure,

and provide the Service and does not use them to infer characteristics about

you. Stripe, rather than Oobie, processes full payment-card details.

Oobie did not sell or share any category of personal information for

cross-context behavioral advertising during the preceding 12 months. The

retention criteria for each operational category are described in Section 7.

13. Children's privacy

The Service is intended for adults and is not directed to anyone under 18.

Oobie does not knowingly collect personal data from a person under 18. If you

believe a minor has used the Service, contact

[[email protected]](mailto:[email protected]). We will investigate and take

appropriate steps, which may include closing the account and deleting the

information.

14. Changes to this policy

We may update this policy as the Service or law changes. We will post the

revised policy, update the effective date, and provide additional notice when

required. Material changes apply prospectively unless law permits otherwise.

How Oobie Works

This page is a plain-English overview of how [TRADING_NAME] works, so you know

what to expect when you use it. It is a friendly explainer, not a contract — your

use of the Service is governed by our Terms of Service, Privacy Policy, Billing

terms, and Acceptable Use Policy.

The basic idea

[TRADING_NAME] is an AI-assisted CAD tool. Instead of starting from a blank

canvas, you describe the part or assembly you want in plain language (and, where

helpful, with parameters or reference files), and the Service generates an

editable CAD model you can work with.

What the experience looks like

1.You describe what you want. Tell the Service about the part or assembly —

its purpose, dimensions, features, and any constraints that matter to you.

2.The AI generates editable CAD. Using third-party AI model providers, the

Service produces a CAD model and related artifacts based on your description.

3.You review and iterate. Inspect the result, refine your description, and

regenerate or adjust until the design is closer to what you need. Your project

keeps a history of revisions as you go.

4.Larger jobs take longer. Simple parts can be ready quickly, while bigger

or more complex assemblies are processed in the background and may take

longer to complete.

What to expect on time and cost

Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Oobie

("Oobie," "we," "us," or "our"). They govern your access to and use of

[oobie.ai](https://oobie.ai), Oobie applications, Oobie APIs, and related

services (collectively, the "Service").

Please read these Terms carefully. The Service uses artificial intelligence and

can produce incorrect or unsafe designs. Sections 8, 13, and 14 contain

important safety requirements, warranty disclaimers, and limits on liability.

1. Acceptance and eligibility

By creating an account, clicking to accept, purchasing a plan, or using the

Service, you agree to these Terms and acknowledge Oobie's Privacy Policy. If

you do not agree, do not use the Service.

You must be at least 18 years old and old enough to form a binding contract

where you live. If you use the Service for a company or other organization, you

represent that you have authority to bind that organization, and "you" includes

the organization.

2. The Service

Oobie provides AI-assisted engineering and CAD features, which may include

chat, generation and editing of CAD artifacts, cloud project storage,

versioning, collaboration, connected tools, diagnostics, and related services.

Features, models, providers, limits, and availability may change over time.

The Service is a design aid. It is not a professional engineer, architect,

manufacturer, certification body, testing laboratory, or safety authority.

Oobie does not approve a design for manufacturing, regulatory compliance, or

safety-critical use.

3. Accounts and security

You must provide accurate information and keep it current. You are responsible

for:

protecting passwords, access tokens, connected-service credentials, and

devices used to access the Service;

using reasonable controls for collaborators and organization users;

promptly notifying [[email protected]](mailto:[email protected]) if you suspect

unauthorized access; and

activity you authorize or fail to prevent through a breach of these duties.

You may not share an individual account in a way that bypasses plan limits or

misrepresents the person using it. Oobie may require email verification or

additional security steps. Oobie records the version, timestamp, IP address,

and user agent associated with acceptance of these Terms and the Privacy Policy.

4. Plans, subscriptions, and payment

Some features are free and others require a paid plan or usage charge. The

checkout flow or order form will show the price, billing frequency, included

usage, material limits, and any plan-specific terms before you purchase.

If you choose a recurring plan:

you authorize Oobie and Stripe to charge the payment method you provide at

the stated frequency until you cancel;

the subscription renews automatically for the disclosed renewal period unless

you cancel before renewal;

usage-based charges may be billed in addition to the recurring fee when that

is disclosed for your plan; and

taxes may be added where required.

You can cancel an online subscription through the billing controls or payment

portal made available with the Service. Cancellation normally takes effect at

the end of the paid billing period, unless the purchase flow states otherwise

or applicable law requires a different result. Canceling a subscription does

not automatically delete your account or User Content.

Except where required by law or stated at purchase, fees are non-refundable and

consumed usage is not refundable. If Oobie materially changes a recurring price

or renewal term, we will provide advance notice and a way to cancel as required

by law. Oobie may suspend paid features for overdue amounts after reasonable

notice.

Stripe processes payment-card information under Stripe's terms and privacy

policy. Oobie does not store full payment-card numbers.

5. User Content and outputs

"User Content" means prompts, messages, specifications, files, CAD models,

scripts, designs, project records, feedback, and other material you submit,

store, or generate through the Service. "Input" means User Content you provide

to request a result. "Output" means material the Service generates in response.

Your rights

As between you and Oobie, you retain the rights you have in your Input. Oobie

does not claim ownership of your Output. To the extent Oobie obtains a right in

an Output, Oobie assigns that right to you, subject to applicable law,

third-party rights, and these Terms.

AI-generated material may not qualify for intellectual-property protection.

Outputs may be similar or identical to material generated for other users, and

Oobie does not promise that an Output is unique, protectable, or

non-infringing.

License to operate the Service

You grant Oobie a worldwide, non-exclusive, royalty-free license to host, copy,

process, transmit, display, modify, and create technical derivatives of User

Content only as reasonably necessary to:

provide the features you request, including model processing, conversion,

storage, previews, collaboration, and connected tools;

secure, maintain, troubleshoot, and support the Service;

enforce these Terms and protect users and the public; and

comply with law and valid legal process.

This license lasts while Oobie stores the relevant User Content and for the

limited period needed to complete deletion, maintain backups, resolve disputes,

or comply with law. Oobie's handling of personal data is described in the

Privacy Policy.

Your responsibility for User Content

You represent that you have the rights and permissions needed to submit and use

User Content. You must not submit material that violates law, confidentiality,

privacy, publicity, contract, export-control, or intellectual-property rights.

Do not submit trade secrets, personal data, regulated data, or export-controlled

technical data unless you are authorized to do so and its processing by Oobie,

external model providers, and any connected service is appropriate.

Collaboration and public projects

Projects are private by default, but you may add collaborators or make a

project public. Your settings determine who may view, copy, change, fork, or

interact with a project. Once information is shared, a collaborator or member of

the public may retain a permitted copy even after you change visibility or

delete your copy. You are responsible for choosing appropriate sharing and

webhook settings.

Feedback

If you send ideas or feedback about the Service, you grant Oobie a perpetual,

irrevocable, worldwide, royalty-free license to use and incorporate that

feedback without payment or attribution. This paragraph does not give Oobie a

license to unrelated User Content.

6. Third-party models, tools, and services

The Service relies on third parties, including AI model and model-routing

providers, cloud infrastructure, Stripe, email delivery, and services you

connect. Oobie may send relevant Input, context, tool calls, and results to

those parties to provide the requested feature.

A third-party service is governed by its own terms and privacy policy. You are

responsible for reviewing them and for any permissions, fees, or credentials

needed to use that service. Oobie is not responsible for a third-party service

that it does not control, but these Terms do not limit any responsibility Oobie

cannot disclaim under law.

7. Acceptable use

You may use the Service only lawfully and in accordance with these Terms. You

must not use the Service to:

create, obtain, or distribute unlawful content or facilitate unlawful

activity;

design weapons intended to harm people or defeat safety mechanisms;

infringe, misappropriate, or violate another person's rights;

upload malware or attempt unauthorized access, probing, interference, or

disruption;

reverse engineer, decompile, extract, or discover non-public models, source

code, or systems, except to the extent law does not allow this restriction;

scrape or automate access beyond documented interfaces or written permission;

bypass security, approval flows, quotas, rate limits, billing, or access

controls;

impersonate another person, provide materially false account information, or

use another person's credentials without permission;

harass, exploit, or endanger another person or a minor; or

violate sanctions, export-control, import, or trade laws.

Oobie may investigate suspected misuse and may remove content, restrict a

feature, suspend access, preserve evidence, or report unlawful activity when

reasonably necessary. We will consider context and proportionality where

practical.

8. AI and engineering safety

> IMPORTANT: Outputs may be inaccurate, incomplete, defective, unsafe,

> non-compliant, or unsuitable for your purpose. You must not rely on an Output

> as the sole basis for manufacturing, fabrication, construction, medical use,

> transportation, critical infrastructure, or any other real-world or

> safety-critical application.

Before relying on an Output, you must have a qualified person independently

review it and must perform appropriate calculations, simulations, inspections,

tests, tolerancing, material review, and regulatory or standards checks. You

are solely responsible for manufacturing decisions, physical prototypes,

quality control, certifications, labels, instructions, and the safe use of any

result.

Oobie does not guarantee a generation time, cost estimate, geometry, material

selection, fit, tolerance, manufacturability, interoperability, patent

clearance, code compliance, or professional conclusion.

9. Oobie's intellectual property

Oobie and its licensors own the Service, including its software, interfaces,

design, documentation, branding, and non-user content. Subject to these Terms,

Oobie grants you a limited, non-exclusive, non-transferable, revocable right to

use the Service for your own lawful purposes during the term.

No right is granted to use Oobie trademarks or to copy, resell, sublicense, or

commercialize the Service itself. These restrictions do not prevent you from

commercializing your lawful User Content or Output, subject to Section 5.

10. Copyright and rights complaints

If you believe material available through the Service violates your rights,

email [[email protected]](mailto:[email protected]) with:

your contact information;

a description of the protected work or right;

the location of the material;

a good-faith explanation of the claimed violation; and

a statement that your report is accurate and you are authorized to submit it.

Oobie may request additional information and may remove or restrict material

while reviewing a report. This process is not a substitute for any formal

notice procedure required by applicable law.

11. Suspension, cancellation, and termination

You may stop using the Service at any time. You may cancel a subscription as

described in Section 4 and may request account closure by contacting

[[email protected]](mailto:[email protected]). Use available controls to export

or delete projects and clear stored chat history before closing an account.

Oobie may suspend or terminate access if you materially breach these Terms,

create a security or safety risk, fail to pay, expose Oobie or another person to

legal liability, or if suspension is required by law. When practical, Oobie

will provide notice and a reasonable opportunity to cure a remediable breach.

Immediate action may be taken for urgent safety, security, fraud, or legal risk.

When access ends, the license to use the Service ends. Sections that by their

nature should survive will survive, including Sections 5, 8 through 10, and

13 through 17. Data handling after termination is described in the Privacy

Policy.

12. Changes and availability

Oobie may add, modify, suspend, or discontinue features. We do not promise that

every feature, model, file format, integration, or free offering will remain

available. When practical, we will provide notice of a material discontinuation

that affects paid customers and a reasonable opportunity to export supported

User Content.

Oobie may update these Terms. Material changes will be posted with a new

effective date, and Oobie will provide additional notice or request renewed

acceptance when required. Changes apply prospectively. If you do not agree to

updated Terms, you must stop using the Service before they take effect.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service and all Outputs are

provided "as is" and "as available." Oobie disclaims all express, implied, and

statutory warranties, including warranties of merchantability, fitness for a

particular purpose, title, accuracy, non-infringement, and quiet enjoyment.

Oobie does not warrant that the Service will be uninterrupted, error-free,

secure, compatible with every system, or that defects will be corrected. Oobie

does not warrant that an Output is accurate, complete, unique, safe,

manufacturable, legally protectable, or suitable for real-world use.

Some jurisdictions do not allow certain disclaimers. In those jurisdictions,

the disclaimers apply only to the extent permitted, and nothing in these Terms

limits a warranty or consumer right that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Oobie and its affiliates, officers,

employees, contractors, licensors, and suppliers will not be liable for:

indirect, incidental, special, consequential, exemplary, or punitive

damages;

loss of profits, revenue, business, opportunity, goodwill, or data; or

losses arising from manufacturing, fabrication, construction, testing, or

real-world use of an Output,

even if advised that such loss is possible.

To the maximum extent permitted by law, the aggregate liability of Oobie and

the parties listed above for all claims arising out of or relating to the

Service or these Terms will not exceed the greater of (a) the amount you paid

Oobie for the Service during the 12 months before the event giving rise to the

claim or (b) USD $100.

These limits do not apply to liability that cannot lawfully be limited,

including liability for fraud, willful misconduct, or death or personal injury

caused by negligence where applicable law prohibits the limitation. Each

limitation applies to the fullest lawful extent, even if a remedy fails of its

essential purpose.

15. Business-user indemnity

If you use the Service on behalf of a business or organization, that

organization will defend and indemnify Oobie and its affiliates, officers,

employees, and contractors from third-party claims, damages, and reasonable

legal costs arising from:

the organization's User Content or use of an Output;

its violation of these Terms or applicable law; or

its infringement or misuse of another person's rights.

Oobie will provide prompt notice and reasonable cooperation, and the

organization may control the defense with counsel reasonably acceptable to

Oobie. This section does not require indemnification for Oobie's own fraud,

willful misconduct, or liability that cannot be shifted by law.

16. Disputes and applicable law

Before filing a claim, you and Oobie agree to try in good faith to resolve it

informally. Send a written notice to

[[email protected]](mailto:[email protected]) describing the issue and requested

relief. If the dispute is not resolved within 30 days, either party may pursue

available remedies.

These Terms are governed by the law that a court with jurisdiction determines

to be applicable, without overriding mandatory consumer protections. Disputes

may be brought in any court that has lawful subject-matter and personal

jurisdiction. These Terms do not require arbitration and do not waive a right

to participate in a class action where that right otherwise exists.

17. General terms

These Terms and any plan or order terms accepted at purchase are the entire

agreement about the Service, except for a separate written agreement signed by

Oobie. A signed agreement controls to the extent of a conflict.

You may not assign these Terms without Oobie's written consent. Oobie may

assign them in connection with a merger, reorganization, financing, or sale of

the relevant business. If a provision is unenforceable, it will be modified to

the minimum extent necessary and the remaining provisions will continue. A

failure to enforce a provision is not a waiver.

Oobie is not liable for delay or failure caused by events beyond its reasonable

control. Section headings are for convenience only. "Including" means

"including without limitation." Electronic notices and records satisfy any

written-notice requirement to the extent permitted by law.
